Divorce and Property Division
There are many moving parts to a divorce, but Jill and JR can guide you through any type of divorce — including contested divorce, uncontested divorce, or high-conflict divorce.
One of the major issues in a divorce is the division of marital property. Indiana law presumes that each party will equally split the assets and debts, 50 percent to Wife and 50 percent to Husband. However, each side can argue as to why 50-50 is not fair. If there is a disagreement about what’s considered property or liability, then you’ll want to consult with a lawyer immediately.
The 50-50 presumption continues with retirement benefits. Most 401(k) plan can be divided using a special provision in the IRS Code called a Qualified Domestic Relations Order (QDRO) in order to minimize any tax implications. It is not uncommon for there to be situations where one spouse feels that 50-50 is not fair and argue a larger share. If you feel like this is unfair, or you want to contest this, then it’s best to talk with a lawyer to get the best possible outcome.
After a marriage ends, the state of Indiana assumes that both spouses will support themselves and no longer have an obligation to support the other. However, there are three exceptions: (1) if one spouse is disabled and unable to work, (2) if one spouse has been out of the workforce and needs additional education or training before reentering the workforce, or (3) there is a disabled child. If one of these situations exist then one spouse may have to pay what’s called spousal maintenance.
Child Custody and Child Support
When a child is involved in a divorce, it’s best if the Mother and Father can reach an agreement on their own. However, in some cases, it might be difficult for both parties to agree on child support and child custody arrangements. It’s always wise to make custody decisions in the child’s best interests.
Child support is calculated based on each parent’s income, childcare expenses, medical insurance premiums, and more. Typically, the non-custodial parent pays child support to the custodial parent each week. Believe it or not, sometimes there are disagreements over determining how income, childcare expenses, and insurance premiums are calculated, which is why it’s best to consult with a lawyer.
