Our Indianapolis Family Law Services

When it comes to family law matters, it is virtually impossible to craft an agreement that makes everyone happy. However, with our experience in family law issues including, divorce, property division, retirement benefits, spousal maintenance, child support, and child custody, finding a resolution does not have to be a win or lose proposition.

Divorce and Property Division

Indiana law creates a presumption that each party is entitled to 50 percent of the marital property. In most cases, each party is awarded 50 percent of the marital estate and 50 percent of the marital debt.

If you believe this law has wronged you, contact the professionals at Emerson Law LLC today.

Retirement Benefits

Indiana law observes that retirement benefits are a marital asset that must be included in the marital estate and divided equitably. Even if only one spouse receives retirement benefits, the other spouse is generally entitled to 50 percent of the earned benefits. These benefits are often divided using a special provision of the Internal Revenue Code called a Qualified Domestic Relations Order (QDRO).

If you are divorcing and you or your spouse have retirement accounts, you should seek legal advice immediately.

Spousal Maintenance

After a divorce, the state presumes that each spouse will be able to support themselves. There are three exceptions:

  1. A disabled spouse;
  2. A disabled child; or,
  3. A spouse who plans to attend or is attending school in order to find a job.

If you are divorcing and contemplating spousal maintenance, the team at Emerson Law LLC wants to help you get what you deserve and what is fair.

Child Support and Child Custody

Divorce can be messy and there is a lot to consider — so it’s natural that both parties might start worrying about child support and custody.

If you disagree with the sum you’ve been asked to pay each month, or are struggling to come to terms with who should be the primary physical provider for your child, then contact Emerson Law LLC today. Our team can help you get the best outcome for your family while also keeping the sensitivity of this matter in mind.

“I am here to help. I am not here to judge,” says Jill Bracken-Emerson. “For over 20 years, I have been helping people in difficult situations, and I would be happy to speak with you to see how I might be able to help you too.”

Criminal Defense

If you have been charged with a crime, allow the professionals at Emerson Law LLC help you to understand the criminal process and the criminal penalties in Indiana.

If you have been charged with a crime such as domestic violence or driving/operating a vehicle under the influence, we regularly request video footage from body and dashcams, breathalyzer maintenance records to ensure equipment is giving accurate results, and conduct depositions of the relevant witnesses in order to defend your rights. These are serious crimes that can result in severe punishment, so the first step is hiring an attorney that is on your side and will fight for you no matter what.
