Jill Bracken-Emerson, Attorney
I am a Partner with Emerson Law LLC. I have spent my legal career helping people and businesses deal with the legal issues they face -- whether it is a severe injury or death of a loved one because of someone else's negligence or a risk management or human resources issue faced by a company. I routinely represent people who have been injured because of auto accidents, falls, nursing home neglect, birth injuries, medical malpractice, and dental malpractice. I also regularly represent families who have lost a loved one because of wrongful death.
I have extensive jury trial experience, having tried seven medical malpractice jury trials to verdict either as first- or second-chair. I have significant experience representing clients in both civil and criminal appeals to the Indiana Court of Appeals, the Indiana Supreme Court, and the Seventh Circuit Court of Appeals. I routinely represent clients in state courts around the State of Indiana, and comfortably represent clients in the federal court of the Southern District of Indiana.
I am honored to have been named as one of the top 100 trial lawyers in the State of Indiana by the National Trial Lawyers Association. The National Trial Lawyers Top 100 is an invitation-only organization composed of the premier trial lawyers from each state in the nation who meet stringent qualifications as civil plaintiff and/or criminal defense trial lawyers. Selection is based on a thorough multi-phase process which includes peer nominations combined with third-party research. Membership is extended solely to the select few of the most qualified attorneys who demonstrate superior qualifications of leadership, reputation, influence, stature, and public profile.
I am also honored to have been selected as a barrister in the Sagamore Inn of Court. The Sagamore Inn of Court is an invitation only group of civil and criminal attorneys and judges practicing in the metropolitan Indianapolis area.
When I'm not practicing law, I am at home spending time with my three middle-school age kids. I grew up on a farm near Crawfordsville, Indiana where I learned the value of hard work and doing the right thing. After high school, I graduated from Purdue University, then from law school at the Indiana University McKinney School of Law with honors in 1995. My family and I live in Zionsville now. My kids play a lot of sports, so you can often find me at a basketball game or softball game routing on their teams. My oldest daughter excels in the arts, so you may find us attending the school drama club performance or viewing her artwork each March during Youth Art Month. My kids are also involved in 4-H, where they show our family dogs in dog obedience at the Boone County Fair and the Indiana State Fair. My husband is an avid golfer - me, not so much - but I like being outside during the summer so I often tag along to drive the cart.

For many parents, child custody and parenting time problems create a great amount of unease. Basically in Indiana courts will resolve any dispute about child custody and parenting time according to the best interests of the children involved.
Child support comes with rights and responsibilities. Normally the non-custodial parent pays the parent with primary physical custody a monthly amount which is more or less fixed by the Indiana Child Support Guidelines.
Indiana law creates a presumption that each party to a marriage is entitled to 50% of the marital property. This presumption can vary, but in most cases, each party is awarded 50% of the marital property and 50% of the marital debt.
